Welcome to ThreeSixty Movement! The terms "we," "us," and "our" refer to ThreeSixty Movement. ThreeSixty Movement operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping and learning experience (the "Services"). ThreeSixty Movement is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

By agreeing to these Terms of Service, you represent that you are at least 18 years old, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing any of the products or courses we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our store is correct, current, and complete, and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

We have made every effort to provide an accurate representation of our products in our online store. However, please note that colors or product appearance may differ from how they appear on your screen due to the type of device you use and your device settings.

We do not warrant that the appearance or quality of any products purchased by you will meet your expectations or be identical to how they are depicted in our online store.

All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities we offer to any person, region, or jurisdiction, on a case-by-case basis.

Product safety: Our physical products are designed for general comfort, posture, and mobility support. They are not medical devices and are not intended to diagnose, treat, or cure any medical condition. Always follow the usage instructions and safety information listed on each individual product page, and consult a physician before use if you have a pre-existing condition, are pregnant, or are otherwise unsure whether a product is appropriate for you.

SECTION 3 - DIGITAL PRODUCTS AND COURSE LICENSE

When you purchase the ThreeSixty Mobility Course or any other digital course we offer, you receive a personal, non-transferable license to access and use that content for your own individual use. You may not share your login credentials, download and redistribute course videos or materials, resell or sublicense your access, or make course content available to any third party. We reserve the right to revoke access without refund if this section is violated.

SECTION 4 - ORDERS

When you place an order, you are making an offer to purchase. ThreeSixty Movement reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until ThreeSixty Movement confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as ThreeSixty Movement may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, change, or cancel an order, we will attempt to notify you using the email, billing address, and/or phone number provided at the time of order.

Your purchases are subject to return or exchange solely in accordance with our Return & Refund Policy.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 5 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as shown in your order confirmation email. Unless otherwise stated, posted prices do not include applicable taxes, customs, or import charges; shipping is currently offered free of charge internationally as stated at checkout.

Prices posted in our online store may differ from prices offered elsewhere. We may run promotions governed by separate terms; if there is a conflict between promotion terms and these Terms, the promotion terms govern.

You agree to provide current, complete, and accurate purchase, payment, and account information, and to promptly update it (including your email address and card details) so we can complete your transactions and contact you as needed.

You represent and warrant that: (i) the payment information you provide is true, correct, and complete; (ii) you are duly authorized to use the payment method for the purchase; (iii) charges incurred will be honored by your payment provider; and (iv) you will pay all charges at the posted prices, including shipping (where applicable) and taxes.

SECTION 6 - SHIPPING AND DELIVERY

We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

SECTION 7 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brand names, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by ThreeSixty Movement, its affiliates, or licensors, and are protected by copyright, trademark, and other applicable intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent. Nothing in these Terms grants any license or right to you under any patent, trademark, copyright, or other intellectual property of ThreeSixty Movement, Shopify, or any third party. All rights not expressly granted here are reserved by ThreeSixty Movement.

ThreeSixty Movement's names, logos, product and course names, designs, and slogans are trademarks of ThreeSixty Movement. You must not use these trademarks without our prior written permission. Shopify's name, logo, and related marks are trademarks of Shopify. All other names, logos, and marks on the Services belong to their respective owners.

SECTION 8 - OPTIONAL TOOLS

You may be provided access to tools offered by third parties as part of the Services, which we neither monitor nor control. We provide access to such tools "as is" and "as available," without warranties of any kind and without endorsement. We have no liability arising from your use of optional third-party tools. Any use of these tools is entirely at your own risk, and you should review the relevant third party's own terms.

SECTION 9 - THIRD-PARTY LINKS

The Services may contain links to websites operated by third parties. We are not responsible for evaluating the content or accuracy of any third-party materials, and if you leave our Services to access them, you do so at your own risk. We are not liable for any harm related to your access, purchase, or use of anything on a third-party website. Direct any complaints about third-party products or services to that third party.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

ThreeSixty Movement is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with ThreeSixty Movement. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sale between you and ThreeSixty Movement, including any injury, damage, or loss resulting from purchased products or courses. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from your purchases and transactions with ThreeSixty Movement.

SECTION 11 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy, viewable here. By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services. Information you submit will be transmitted to and shared with Shopify and other third parties, potentially in other countries, in order to provide the Services to you.

If you submit any ideas, suggestions, feedback, or reviews ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and display such Feedback for any purpose, including commercial use. We reserve the right to correct these and to change, update, or cancel orders based on inaccurate information at any time, including after an order has been submitted.

We may limit or block Agent access at our discretion.

We may terminate this agreement or your access to the Services at any time, in our sole discretion, without notice, and you will remain liable for all amounts due up to the date of termination. Sections that by their nature should survive termination — including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, and Governing Law — will continue to apply.

SECTION 18 - LIMITATION OF LIABILITY

To the fullest extent permitted by law, ThreeSixty Movement, our partners, directors, officers, employees, affiliates, agents, contractors, and service providers, and those of Shopify and its affiliates, will not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind — including lost profits, lost revenue, or lost data — arising from your use of the Services or any product or course, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.

Nothing in this section excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or any statutory consumer protection rights available to you under the law of your country of residence.

SECTION 19 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless ThreeSixty Movement, Shopify, and our respective affiliates, officers, directors, employees, and agents from any losses, damages, liabilities, or claims — including reasonable legal fees — arising from (1) your breach of these Terms, (2) your violation of any law or third-party right, or (3) your access to and use of the Services.

SECTION 20 - SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remainder will be severed without affecting the validity of the remaining provisions.

SECTION 21 - WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms, together with any policies referenced herein, constitute the entire agreement between you and us regarding the Services, superseding any prior agreements or communications.

You may not transfer or assign this agreement or any of your rights or obligations under these Terms without our prior written consent. We may transfer or assign these Terms without notice to you.

SECTION 23 - GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of Sweden. Any disputes arising from these Terms or your use of the Services will be subject to the exclusive jurisdiction of the courts of Sweden.

If you are a consumer residing in the EU/EEA or elsewhere, this choice of law does not deprive you of the protection afforded by any mandatory consumer protection provisions of the law of your country of residence, which continue to apply regardless of this clause.

The headings used in this agreement are included for convenience only and do not limit or otherwise affect these Terms.
